Terms of Service
These Terms are the agreement between you and VerifyMaill for use of our email verification and deliverability platform. We've written them in plain English wherever the law lets us.
1. Acceptance of Terms
These Terms of Service (the "Terms") form a binding agreement between you, or the organisation you represent ("you"), and 47labz ("47labz", "we", "us"), the company that operates VerifyMaill, the email verification and deliverability platform at https://verifymaill.com, together with its related products, APIs, dashboards and services (the "Service").
By creating an account, clicking "I agree", or using any part of the Service, you accept these Terms (including the Acceptable Use rules in Section 4), our Privacy Policy, Anti-Spam Policy and Abuse Policy, which are incorporated by reference. If you do not agree, do not use the Service. If you are using the Service for an organisation, you confirm you have authority to bind that organisation.
2. The Service
VerifyMaill verifies and scores email addresses and provides related deliverability tools, which may include bulk verification, a real-time verification API and widget, disposable / role / accept-all / free-mailbox detection, syntax, domain and SMTP checks, deliverability and inbox placement testing, DMARC and blacklist monitoring, and an email finder. The features available to you depend on your plan and credit balance.
We are continually improving the Service. We may add, change or remove features, and we may set or adjust technical limits (such as rate limits, batch sizes or fair-use thresholds) to keep the Service reliable for everyone. We will not make changes that materially reduce the core functionality of a paid plan during a billing period you have already paid for, except where required for security, legal or operational reasons.
3. Eligibility & Accounts
You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. The Service is intended for business and professional use.
You are responsible for your account. That means you agree to:
- provide accurate registration details and keep them up to date;
- keep your password and API keys confidential, and not share your account;
- tell us promptly at team@verifymaill.com if you suspect unauthorised use; and
- accept responsibility for all activity carried out through your account or API keys.
4. Acceptable Use
You agree that you will not, and will not allow anyone else to:
- upload or verify email addresses you do not have a lawful basis to process (see Section 5);
- use the Service to enable spam or unsolicited messaging, or to validate lists for that purpose, see our Anti-Spam Policy;
- use the Service for anything unlawful, harmful, deceptive, or that infringes others' rights, see our Abuse Policy;
- resell, sublicense, or provide the Service to third parties as your own, except through an interface we authorise;
- copy, scrape, reverse-engineer, or attempt to derive the source code of the Service, except to the extent the law expressly permits;
- probe, overload, or interfere with the Service or its infrastructure, or bypass usage limits, authentication or billing; or
- create multiple accounts to abuse free credits, trials or rate limits.
We may suspend or limit use that we reasonably believe breaches these rules or threatens the security, integrity or reputation of the Service (see Section 13).
5. Your Data & Lists
You keep ownership of the email addresses and other data you submit to the Service ("Customer Data"). You grant us a limited licence to process Customer Data only to provide and support the Service.
You represent and warrant that, for all Customer Data you submit, you:
- collected it lawfully and have a lawful basis to process it (for example legitimate interest or consent);
- are entitled to have us verify it on your behalf; and
- will not use the results in a way that breaks applicable law or these Terms.
Where you submit personal data of individuals in the EEA, UK or other regulated regions, we act as your processor and you as the controller. Our Data Processing Agreement governs that relationship and is incorporated into these Terms. We explain how we handle data in our Privacy Policy and GDPR page.
6. Credits, Plans & Billing
How credits work
The Service runs on credits. One email verification normally costs one credit; some actions (such as SMTP / server tests, email-finder lookups or inbox placement tests) cost more credits. Current prices and credit costs are shown on our Pricing page and may be updated from time to time; the prices in effect when you buy apply to that purchase.
You only pay for results. We deduct a credit only when we can conclusively classify an address. If we cannot return a definitive result (an "unknown" / unverifiable outcome), no credit is charged for that address.
Pay-as-you-go vs. subscription
- Pay-as-you-go credits are bought up-front and, unless stated otherwise at purchase, do not expire while your account is active.
- Subscription credits refresh at the start of each billing cycle and do not roll over to the next cycle unless your plan says so.
Payments & Merchant of Record
Payments are processed by our payment provider, Polar (https://polar.sh), which acts as our Merchant of Record. This means Polar is the seller of record for your purchase and is responsible for processing payment and for collecting and remitting any applicable sales tax, VAT or GST. Your purchase is also subject to Polar's terms shown at checkout. Prices are exclusive of taxes unless stated. We may change our payment provider in the future; if we do, this section will be updated.
Subscriptions renew automatically for the same period until cancelled. You can cancel renewal at any time from your account or by contacting us; cancellation takes effect at the end of the current paid period, and you keep access until then.
7. Refunds & Guarantee
Credits and subscription fees are generally non-refundable once purchased, except:
- as set out in our Guarantee (our accuracy promise and how we put it right);
- where a refund is required by mandatory law that applies to you (for example certain consumer-protection or distance-selling rights in the EU, UK or India); or
- where we choose to grant one at our discretion.
Approved refunds are processed through our payment provider, Polar. Because verification results are delivered to you immediately and consumed as you use them, statutory "cooling-off" rights for digital services may not apply once you have started using purchased credits; nothing in these Terms removes any right you cannot waive under the law that applies to you.
8. Intellectual Property
The Service, including its software, design, content, trademarks and the VerifyMaill name and logo, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the Service, without obligation to you.
9. Third-Party Services
The Service may integrate with or link to third-party products (for example payment providers, integrations and infrastructure providers listed in our Privacy Policy). We are not responsible for third-party products, and your use of them is governed by their own terms and policies.
10. Disclaimers
Email verification is predictive, not a guarantee of delivery. We use a combination of syntax, domain, MX, SMTP and reputation checks to assess, at the time of the check, whether an address is likely to accept mail. However, mail systems change, mailboxes fill or close, and some servers deliberately obscure whether an address exists (for example catch-all / accept-all domains, greylisting and anti-spam defences). A result of "deliverable", "valid" or any score is therefore our best assessment at that moment, not a warranty that a message you later send will be delivered, accepted, opened or read. Our accuracy commitment, and your remedy for it, is set out in the Guarantee, which is your sole and exclusive remedy for verification accuracy.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by law, VerifyMaill will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid to us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the law that applies to you (for example liability for fraud or for death or personal injury caused by negligence).
12. Indemnification
You agree to indemnify and hold harmless VerifyMaill and its people from any claims, losses, liabilities and reasonable costs (including legal fees) arising out of or related to: (a) the Customer Data you submit, including any claim that you did not have the right to upload or process it; (b) your use of verification results, including any messages you send to addresses you verified; or (c) your breach of these Terms, the Anti-Spam Policy, the Abuse Policy, or applicable law.
13. Suspension & Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms or our policies, if required by law, or to protect the Service, other users or third parties. Where practical and lawful, we will give you notice and a chance to fix the problem.
On termination, your right to use the Service ends. Sections that by their nature should survive (including data ownership, intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive. We handle your data after termination as described in our Privacy Policy: in short, you can delete your data at any time, and we delete account data within 30 days of account closure unless we must keep it for legal reasons.
14. Governing Law
These Terms and any dispute arising from them or the Service are governed by the laws of India, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the competent courts of India for any dispute, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
If you are a consumer in the EU, UK or another region with mandatory local protections, this clause does not deprive you of rights you have under the law of your home country, and you may also be able to bring proceedings there.
15. General
- Entire agreement
- These Terms and the policies they reference are the entire agreement between you and us about the Service and replace any earlier agreements on that subject.
- Assignment
- You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- Severability & waiver
- If any provision is held unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it.
- Force majeure
- We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices
- We may give you notices by email or through the Service. You can reach us at team@verifymaill.com.
16. Changes to These Terms
We may update these Terms from time to time. If a change is material, we will give reasonable notice (for example by email or an in-product notice) before it takes effect. The version posted on this page is always the current one. Continuing to use the Service after a change takes effect means you accept the updated Terms.
